BC Home Improvement Club Membership (BCHIC) Terms and Conditions
These Terms and Conditions ("Terms") govern the use of the membership services provided by Bc Home Improvement Club (hereinafter referred to as "BCHIC", "we", "us", or "our"). By purchasing a membership with BCHIC, you agree to comply with these Terms. Please read them carefully before purchasing a membership.
1. Membership Services:
BCHIC provides membership services that connect homeowners with trades and offer discounts on various home improvement projects. These services include but are not limited to providing recommendations for tradespersons and facilitating discounts on home improvement products and services.
2. Membership Renewal:
a. Membership with BCHIC automatically renews at the end of the membership term, unless cancelled by the member.
b. By purchasing a membership, you agree to allow BCHIC to automatically renew your membership using the payment method provided unless you cancel your membership before the renewal date.
c. The renewal will be at the standard prices applicable at the time of renewal, regardless of any discounts or promotional prices offered during the initial membership term.
3. Trade Recommendations:
a. BCHIC may provide recommendations for tradespersons based on information provided by the homeowner.
b. While BCHIC strives to recommend reliable and professional tradespersons, we do not guarantee the quality of their work or their suitability for a particular project.
c. The decision to hire a recommended tradesperson is solely the responsibility of the homeowner, and BCHIC shall not be liable for any damages, losses, or disputes arising from the services provided by recommended tradespersons.
4. Limitation of Liability:
a. BCHIC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our membership services.
b. Homeowners agree to indemnify and hold BCHIC, its officers, directors, employees, and agents harmless from any claims, damages, or liabilities arising from the use of our membership services or the services provided by recommended tradespersons.
5. Membership Termination:
a. BCHIC reserves the right to terminate or suspend a membership without prior notice if we believe that the member has violated these Terms or engaged in fraudulent activities.
b. Members may cancel their membership at any time by contacting BCHIC customer support or through the membership portal on our website.
c. Refunds for cancelled memberships will be issued according to our refund policy, as outlined on our website.
6. Modifications to Terms:
BCHIC reserves the right to modify or update these Terms at any time without prior notice. The updated Terms will be posted on our website, and it is the responsibility of the member to review them periodically.
7. Non-Transferability of Discounts:
a. Discounts offered to members of BCHIC are non-transferable and are intended solely for the member's use.
b. Members are strictly prohibited from transferring, selling, or otherwise providing their membership discounts to non-members or individuals who are not registered members of BCHIC.
c. Any attempt to transfer membership discounts to non-members is a violation of these Terms and may result in immediate termination of the member's membership without refund.
d. BCHIC reserves the right to take legal action against members who engage in the unauthorized transfer of membership discounts.
8. No Refunds After Utilizing Trade Partner Discounts:
a. Members who have availed themselves of discounts from any BCHIC trade partner during their membership term, even for a single transaction, are not eligible for refunds if they choose to cancel their membership before the end of the membership term.
b. By utilizing discounts provided by BCHIC trade partners, members acknowledge that the discounts are offered as part of the membership benefits and agree to fulfill the terms of the membership.
c. In the event of membership cancellation after utilizing trade partner discounts, members forfeit any rights to a refund, and the membership fee shall not be refunded or prorated.
d. This clause applies specifically to memberships where discounts from trade partners have been utilized and does not affect the refund policy for regular memberships as outlined in Section 5.
This set of clauses ensures that members are aware that utilizing trade partner discounts during their membership renders them ineligible for refunds upon cancellation, emphasizing the importance of adhering to the terms and conditions of membership.
9. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of British Columbia, without regard to its conflict of law principles.
By purchasing a membership with BCHIC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you should not proceed with purchasing a membership.
